Bottom-Up Justice: Latin American Leadership in Corporate Complicity and Transitional Justice

The human rights agenda faces a new challenge in the 21st century: incorporating both the issue of economic globalization—which affects social, cultural, and political contexts—and the role of emerging new international actors. With the rise of multinational companies capable of operating transnationally, corporate responsibility for protecting human rights has become central, both locally and internationally.

In this context, we start by asking: What should be the role of the State in the relationship between businesses and human rights? What are the rights and guarantees available to victims in cases of corporate-perpetrated violations? And what strategies can be used to strengthen the prevention, protection, and promotion of human rights in relation to corporate activity? These questions guide the structure of this book. (…)

With the goal of contributing to the understanding of a topic that is highly relevant to the current human rights agenda, the chapters provide insights to address corporate responsibility for human rights violations. They cover various themes, focusing both on international experiences and doctrines, as well as on the instruments and mechanisms that ensure the accountability of violating companies within the Brazilian justice system.
